Environmental management in the Ecuadorian legal system

Abstract

Environmental management is a process on which new approaches are made as a strategy to contribute to the preservation and maintenance of nature. In 2008, the Constitution of the Republic of Ecuador was approved, which incorporates several articles to materialize its application and several laws are approved that advance in the creation of conditions to apply the constitutional principles. The purpose of this research is to analyze environmental management in the Ecuadorian legal system, in order to
promote its sustainability and enhance its development. Methodologically, we worked with the analysis of the Constitution and the main laws governing environmental issues in Ecuador. The results show: a)
Constitutional definition of environmental management framed in the conception of general policies of sustainable development for the conservation of the natural heritage and the sustainable use of natural
resources; 2) Determines the obligations, responsibilities, levels of participation of the public and private sectors in environmental management. It is concluded on the existence of diverse institutional
legal guidelines that favor environmental management, its planning, execution and evaluation, is in function of the strengthening of the good living in Ecuador
